Any person making use of the information, documents, products, software and various services (collectively the "services") offered by the portal is deemed to have read and accepted all the terms and conditions of these general conditions of use.

Definition and purpose
1. The "education.lu" portal is a set of Internet sites, services and applications set up by the MENJE with the aim of facilitating user access to information and services in the context of basic and secondary education.
2. The portal is aimed at teachers, students and administrations in basic and secondary education.
3. Use of the portal is free of charge.

Registration, user account
5. To access specific portal resources or services, users must authenticate themselves. 
4. All teachers and pupils in the Grand Duchy of Luxembourg as well as the administrative staff of the Ministry and the schools are automatically registered via the IAM identity management system (iam.education.lu).
5. The first connection to the portal requires the user to acknowledge that he/she has read, understood and accepted these conditions and that he/she intends to comply with all the conditions of this agreement.
6. All user contributions, whether expressed by sending messages via the various forums and messaging systems or by using the other portal services, are posted directly online.
7. The user authorises the portal to store and disseminate, freely and without restriction, the information communicated on the portal sites.

User obligations
8. Access to the portal sites is via the Internet. Users declare that they are aware of the risks involved and accept them. They must protect themselves against the effects of computer piracy by adopting a suitable and secure computer configuration.
9. The MENJE may not be held liable for any damage that the user may suffer directly or indirectly in connection with browsing the portal sites and using its services or the Internet sites to which it refers.

Modification of the portal
10. MENJE reserves the right to develop, modify or suspend the portal without prior notice for reasons of maintenance, updating or any other reason deemed necessary. In particular, MENJE may at any time withdraw, add to, complete or specify all or part of the information and services contained or offered on the portal. MENJE may not be held liable for any direct or indirect damage arising from such modifications.

General limitations of liability
11. MENJE will do its utmost to ensure maximum availability of the portal. However, it cannot be held liable in the event of the portal being temporarily or totally unavailable.
12. MENJE will do its utmost to ensure the security of the computer system. MENJE's liability is therefore expressly excluded for any direct or indirect consequences:

  • lack of compatibility between the service offered and the equipment, applications, procedures or infrastructures of the user or third parties;
  • a security breach caused by the user or a third party, and more generally any security breach not directly attributable to the portal;
  • the consequences of errors and/or fraud committed by the user or a third party;
  • any unavailability or malfunction of electronic communications systems or networks.

13. The MENJE will do its utmost to ensure the accuracy of the information or services contained on the portal as well as the advice and information provided by the support centre (Helpdesk). However, it may not be held liable in particular in the event of failure to update information or a form, in the event of system manipulation or encoding errors, inaccuracies, gaps in the information provided or any errors, inaccuracies or omissions in the answers given by the support centre (Helpdesk). Although the aim is to disseminate accurate and up-to-date information from a variety of sources, MENJE cannot avoid all risk of material error. None of the information published on the portal or provided by the support centre (Helpdesk) in response to an individual request is intended to be exhaustive or to constitute a commitment on the part of the MENJE. The popularisations and translations are provided for information purposes only. Only the legal texts published in the Mémorial (Official Journal of the Grand Duchy of Luxembourg) are authentic. The information on the portal is of a general nature. The information is not adapted to personal or specific circumstances and cannot therefore be considered as personal, professional or legal advice to the user. If users require personal or specific advice, they should always consult the relevant departments within the various administrations and schools.
14. Data transmitted to the administrations' online services remains the responsibility of the user, even if it is transmitted by the technical means made available by the portal.
15. Any data or documents that users store in a portal storage space remain their sole responsibility. Use of the storage space does not release the user from the obligation to keep any document of which they may have deposited a copy in this space.
16. The MENJE reserves the right to terminate, without notice or compensation of any kind, access to any area of the portal that is used illegally or fraudulently.

17. For the convenience of users, the portal may contain links to other sites that may be useful or of interest to them. MENJE does not systematically check the content of these sites. It cannot therefore be held responsible for the content of these websites, either in terms of their legality or the accuracy of the information they contain.

Intellectual property
18. The portal, all its elements (including the layout) as well as the information and Services are protected by intellectual property and copyright laws.
19. Unless otherwise indicated, the MENJE does not grant any licence or authorisation relating to the intellectual property rights that it has over the portal, its elements or the Services. Furthermore, no reproduction of the information or Services, in whole or in part, in any form whatsoever and by any means whatsoever, is permitted without the prior written authorisation of the Ministère de l'Education nationale, de l'Enfance et de la Jeunesse.
20. Unless otherwise indicated, users are authorised to consult, download and print the documents and information available under the following conditions:
- documents may only be used for personal, informative purposes and in a strictly private context;
- documents and information may not be modified in any way whatsoever;
- documents and information may not be distributed outside the portal.
21. The rights implicitly or explicitly granted to you above constitute an authorisation to use and under no circumstances a transfer of rights, ownership or any other rights relating to the portal.

Portal availability and development
22. The portal and its services are available 7 days a week, 24 hours a day. However, MENJE reserves the right to develop, modify or suspend one or more services without prior notice for maintenance reasons or for any other reason deemed necessary. Unavailability does not entitle the user to any compensation. In the event of planned unavailability, the user will be informed and invited to make the necessary arrangements. Should the user fail to meet a deadline due to the temporary unavailability of the portal and/or the service, MENJE may not be held liable under any circumstances.

Modification of the general terms and conditions of use
23. These general terms and conditions of use may be amended or supplemented at any time, without prior notice, in line with changes made to the portal, changes in legislation or for any other reason deemed necessary. It is the user's responsibility to inform themselves of the portal's general terms and conditions of use, of which only the updated version accessible online is deemed to be in force. It is possible that between two uses the specific general conditions of use may be modified, and it is the responsibility of the user to read them carefully before each new use of the portal.

Applicable law and competent courts
24. Any dispute relating to the use of the portal and its services shall be subject to Luxembourg law and shall fall within the exclusive jurisdiction of the courts of the Grand Duchy of Luxembourg.
